3. AI‑Generated Outputs

  • Our apps and services may provide automatically generated outputs using artificial intelligence (“AI Outputs”).
  • AI Outputs are provided “as is” and may contain errors, inaccuracies, or inappropriate content.
  • We make no warranties, representations, or guarantees regarding the accuracy, reliability, legality, or suitability of any AI Outputs.

You acknowledge and agree that:

  • AI Outputs are generated automatically and are not reviewed, verified, or endorsed by us.
  • Any reliance on AI Outputs is at your sole risk.
  • Fairymountain Games Limited shall not be liable for any damages, losses, or claims arising out of or in connection with your use of, or reliance upon, AI Outputs.
  • You remain solely responsible for ensuring that your use of AI Outputs complies with applicable laws, regulations, and third‑party rights.

4. User Responsibility & Indemnity

  • You are solely responsible for any data, content, or material you create, upload, or generate using our apps and services, including AI Outputs.
  • You agree to indemnify and hold harmless Fairymountain Games Limited from any claims, liabilities, damages, or expenses arising out of your use of AI Outputs or user‑generated content.

5. Intellectual Property

  • All intellectual property rights in our apps and websites belong to Fairymountain Games Limited or our licensors.
  • You may not use, copy, or distribute our content for commercial purposes without prior written consent.
  • Audio Content We hold commercial licenses for third‑party audio content used in our apps and services. In addition, certain audio may be automatically generated by artificial intelligence (“AI‑Generated Audio”). AI‑Generated Audio is provided “as is” and may contain errors, inaccuracies, or inappropriate content. Fairymountain Games Limited makes no warranties regarding the accuracy, legality, or suitability of AI‑Generated Audio, and we disclaim liability for reliance on such outputs. Users remain solely responsible for ensuring their use of AI‑Generated Audio complies with applicable laws, regulations, and third‑party rights.

6. Push Notifications & Internet Permissions

  • Firebase is used for real‑time data exchange and storage, with anonymized data.
  • Apps require internet permissions for downloading content, displaying ads, and collecting anonymous analytics.

7. Cookies

  • Our app may use cookies to improve functionality, enhance your experience, and provide personalized services, though in some cases cookies may not be set by us directly but by third‑party providers integrated with the app.

8. Tokens & AI Services

  • Tokens are non‑transferable, non‑refundable, and have no monetary value outside the app.
  • AI services may be interrupted, inaccurate, or unavailable. We disclaim liability for any associated losses.
  • Users are expected to use AI Services and tokens responsibly, in compliance with applicable laws.

9. Payments & Subscriptions

  • Free access is available with limited features. Premium services require annual upfront payment via Google Play Store or Apple App Store.
  • Subscriptions auto‑renew unless cancelled. Refunds and cancellations are subject to Google/Apple policies.
  • Prices are displayed in local currency and may change without notice.

Payment Terms:

  • In‑app purchases may include subscriptions, digital goods, or additional features.
  • You authorize Google Play or Apple App Store to charge your selected payment method.

Consumer Rights:

  • Nothing in these Terms affects your statutory rights under Irish or EU consumer law, including your right to withdraw from digital purchases within 14 days.

10. Service Termination

  • We may terminate accounts or services at any time with reasonable cause or violation of these Terms.
  • We are not liable for damages resulting from termination.

11. Limitation of Liability

  • To the maximum extent permitted by law, Fairymountain Games Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • Our total liability shall not exceed the amount paid by you (if any) for use of the app in the twelve (12) months preceding the claim.
  • No Obligation to Use Our apps and services are provided “as is.” If you do not like the app or disagree with these Terms, you are not obliged to use our services. Your sole remedy is to stop using the app.
  • Carve‑out: Nothing in these Terms excludes or limits liability where prohibited by law, including liability for death or personal injury caused by negligence, fraud, or other statutory rights under Irish or EU law.

12. Age Limitations

  • In compliance with Irish law and GDPR, our services are not directed to children under the age of 16.
  • We do not knowingly collect personal data from children under 16. If discovered, such data will be deleted promptly.

13. Social Media

  • Our apps may interact with social platforms (Facebook, Instagram, WhatsApp) to share content.
  • We do not collect data from your social media accounts.

14. Changes to Terms & Privacy Policy

  • We reserve the right to modify these Terms & Conditions or our Privacy Policy at any time.
  • Changes are effective upon posting within the app or on our website.

15. Governing Law & Jurisdiction

  • These Terms & Conditions are governed by Irish law.
  • The courts of Ireland have exclusive jurisdiction over disputes arising from these Terms.

16. Severability

  • If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
